Arck Recruitment (“we”, “our”, “us”) provides technical recruitment and business support staffing solutions across IT and non-IT functions. While we maintain structured and rigorous screening processes, certain risks are inherent in human resource placement. This Disclaimer defines the scope of responsibility between Arck Recruitment, Candidates, and Clients.


1. Candidate Vetting & Limitations

Arck Recruitment follows reasonable and standard professional diligence including (where applicable):

  • Qualification, certification, and credential checks

  • Background & employment verification

  • Reference checks

  • Skill screening and technical evaluation

However, we do not guarantee the accuracy or completeness of information provided by candidates and cannot control a candidate’s conduct after hiring or joining the client organization.

We are not liable for:

  • Misrepresentation or falsified information by candidates

  • Unforeseen performance, behaviour, or misconduct

  • Non-compliance with client-specific protocols, security, or regulations

  • Post-placement issues involving conduct, culture fit, ethics, or stability


2. Client Responsibilities

By engaging with our services, the Client acknowledges and agrees that:

  • The final hiring decision lies solely with the Client

  • The Client must perform internal due diligence and assessment

  • The Client is responsible for onboarding, supervision, and workforce compliance

  • Post-placement management, training, and retention fall outside Arck Recruitment’s responsibility

Clients assume operational and legal risk after candidate acceptance/placement.


3. Healthcare, PHI, & Regulated Hiring (If Applicable)

Where placements involve access to healthcare systems, PHI, or compliance-driven roles:

Arck Recruitment may provide:
✔ Basic HIPAA-awareness trained resources
✔ Business Associate Agreement (BAA) when required

However:

  • The client remains fully responsible for PHI handling compliance

  • Enforcement of privacy/security protocols is the Client’s obligation

  • We do not guarantee regulatory performance or compliance beyond placement


4. Indemnity & Limitation of Liability

To the maximum extent permitted by law, Clients agree to indemnify and hold Arck Recruitment harmless from claims arising out of candidate actions, errors, omissions, data misuse, performance issues, or regulatory breaches post-placement.

Arck Recruitment shall not be liable for any:

  • Indirect, incidental, or consequential damages

  • Loss of revenue, productivity, or operational impact

  • Losses caused by candidate behaviour or performance post-hire

Total liability, if ever applicable, is limited strictly to total service fees paid for the specific engagement.


5. Compliance Statement

Arck Recruitment complies with applicable laws and standards including (but not limited to):

  • Indian IT Act & Data Protection Rules

  • U.S. Equal Employment Opportunity (EEO) Regulations

  • Fair Credit Reporting Act (FCRA)

  • GDPR (where applicable for EU/UK candidate processing)

Clients should seek independent legal advice for regulatory interpretation and risk mitigation regarding internal operations.
