1. Legal Entity

Arck Recruitment operates as a division of Arck IT Services Private Limited, incorporated under the Companies Act, 2013.

Mussheerabad, Hyderabad, Telangana – 500020, India

All contracts, invoices, and legal engagement are executed under Arck IT Services Private Limited.


2. Definitions

  • “Company” – Arck IT Services Private Limited and its recruitment division, Arck Recruitment.

  • “Client” – any entity engaging the Company for hiring/recruitment services.

  • “Candidate” – individual seeking employment opportunities through the Company.

  • “Services” – all recruitment & hiring services provided by the Company.

  • “Agreement” – written contract/SLA executed between Client and Company.


3. Services Provided

The Company provides technical & professional hiring services, including:

  • Full-time & Permanent Technical Hiring

  • Contract / Contract-to-Hire Talent

  • Fractional & On-Demand Recruitment Support

  • Retained Search for Niche Technical Roles (AI/ML, DevOps, Cloud, Data, Security etc.)

  • Background Verification Support (when requested)

Each engagement operates under a separate SLA or Proposal Agreement defining fees, scope, and timelines.


4. Obligations

4.1 Client Responsibilities

Clients agree to:

  • Provide accurate job details, compensation ranges, and hiring criteria.

  • Give timely feedback on submitted candidates & interview stages.

  • Notify the Company if a hired candidate joins directly or via third party.

  • Ensure all hiring processes comply with applicable labor & nondiscrimination laws.

4.2 Candidate Responsibilities

Candidates agree to:

  • Provide truthful and updated information regarding skills & employment history.

  • Disclose any restrictions like non-compete agreements.

  • Maintain confidentiality during recruitment discussions.


5. Payment Terms

  • Invoices are payable within 15 days from date of issue.

  • Overdue payments attract 1.5% interest per month.

  • All payments must be made only to Arck IT Services Private Limited.

  • Refunds (if applicable) are governed strictly by the SLA.


6. Intellectual Property & Data Usage

  • Recruitment methodology, assessments & sourcing processes are proprietary to the Company.

  • Candidates retain rights to their own resumes/work portfolios.

  • All client/candidate information is handled as per Privacy Policy and used only for hiring service delivery.


7. Liability & Disclaimer

  • Company does not guarantee performance/tenure of hired candidates.

  • Liability is limited to the total fee paid for the specific engagement.

  • Not responsible for delays caused by force majeure events.


8. Termination

  • Either party may terminate engagement with 30 days written notice.

  • Immediate termination allowed in case of material breach.

  • Client must clear dues for services delivered till termination date.


9. Governing Law

  • Governed by Indian law.

  • Disputes fall under Hyderabad, Telangana jurisdiction.

  • Mandatory conciliation/arbitration under Arbitration & Conciliation Act, 1996 prior to litigation.


10. Amendments

The Company may modify terms anytime. Continued service usage indicates acceptance.
